APPLICATION TERMS
\nCognituner Oy is a company registered in Finland. In
\nthese Terms of Use, the term \u201cMe\u201d will hereinafter be
\nused for Cognituner. More about us in \u2018About Us\u2019.
\nWe hope you enjoy our application and how to use it.
\nWe recommend that you read these Terms of Use
\ncarefully and accept them. You should also print or
\nsave these Terms of Use.<\/p>\n
TERMS OF USE
\nThese Terms of Use apply to the application, its
\ncontent and the services we may provide through the
\napplication, and any future updates to the application.
\nUpdates may have other conditions, which we will
\nalways report separately. The privacy policy and rules for the use of cookies are a key part of our application and thus also a key part of our agreement with us. Therefore, we recommend that you read them carefully so that you can accept them.
\nWhen you download our application, you can
\nfamiliarize yourself with its features as well as the
\nservices it offers. Remember that you only have
\naccess to content that you have registered for
\nyourself or that has been licensed to you by a
\nhealthcare professional or that you have purchased
\nfrom the In-App Purchase.<\/p>\n
WHAT HAPPENS IF YOU AGREE TO THESE TERMS OF
\nUSE?
\nIf you accept these Terms of Use, a legally binding
\nagreement will be entered into between us. This
\nagreement is not transferable. With this agreement,
\nwe guarantee you the opportunity to use our
\napplication on your devices (Please note that we may
\nlimit the number of devices you use in the terms of
\nthe agreement). This means that: you have the right to use the application, but you do not own it, its content, or its services. You do not have the right to transfer this agreement to another person or company (this means selling or otherwise transferring the license or giving you access to your IDs). we may grant the same access to other users. It is important that in addition to accepting these terms, you confirm that you have the permission of
\nthe device owner to download the application to the
\ndevice. If the device is yours, the matter is very
\nsimple. If the device is not yours, check with the
\ndevice owner for permission. By accepting these terms, you agree that the application is available for personal use only. It is not possible to do business with the application unless it
\nhas been specifically agreed in other terms and
\nconditions. If you do not agree to the Application Terms of Use, we unfortunately cannot allow you to use our
\napplication.<\/p>\n
ARE THERE COSTS FOR USING THIS APPLICATION?
\nOur application is free to download. You are
\nresponsible for all possible costs incurred in
\ndownloading or using our application (such as Internet
\nor mobile data costs) and for any costs incurred if you
\nmake in-app purchases (in-app purchases).<\/p>\n
ARE IN-APPLICATION PURCHASES AVAILABLE?
\nIt is possible that we offer the ability to make
\npurchases within the app (known as In-App
\nPurchases). If we do so, these purchases between you
\nand your app store will be made on the terms
\nspecified by your app store. We recommend that you
\nread these terms and conditions carefully before
\nmaking a purchase.<\/p>\n
HOW DO WE USE YOUR INFORMATION?
\nWe collect anonymously information about how the
\napplication, its content and services are used.
\nWe collect information when:
\nyou register, log in and use your account. This
\nincludes when you download content to the
\napplication. You fill out registration forms or you are in touch with us. You do the exercises and you get the training results from them. We use the information to improve our service and test our system. We will let the healthcare professional treating you see the results of the exercises you have done. They will be able to identify you and gather medical information about you while tracking how you are
\ndoing in our exercises. This should facilitate the conversation between you and the professional
\ntreating you and help you follow the exercise program
\ndone for you. Please note that we reserve the right to access and monitor information that complies with applicable
\nlaws and regulations so that our system can operate
\neffectively to protect ourselves and our users, as well
\nas potential buyers or partners of our business.<\/p>\n
DO WE USE LOCATION INFORMATION?
\nOur application and some of the services we provide
\nthrough the application may take advantage of
\nlocation information transmitted by your device. If
\nyou use these services with our application, we have
\nthe right to take advantage of them and distribute
\nthem to the professional who controls your service.
\nYou can turn off location services on your device if
\nyou want in your device’s service settings.<\/p>\n
DO WE USE PUSH NOTIFICATIONS?
\nYes, we use push notifications in the app. You can
\nchange their type and also turn them off in your
\ndevice settings or on the settings page of our application. Some notifications may require a WiFi or data connection.<\/p>\n
WHO OWNS THE APPLICATION?
\nThis is an application owned by us and we or our
\nlicensees own all intellectual property rights in the
\napplication, the content contained therein, and the
\nservices that may be provided through the
\napplication. This includes all documents, texts,
\nimages, videos and codes unless otherwise stated. We
\nreserve the right to transfer these rights without your
\npermission. By using our application, you agree that you will not use it illegally or for any illegal and deceptive purpose,
\nmisuse, modify, copy or add anything to the
\napplication code, such as viruses or other data. You
\nalso do not infringe on the intellectual property rights
\nof our partners, distribute defamatory, violent or
\nderogatory content in a manner that could harm,
\nparalyze, impair or violate third party systems or the
\ncollection of information. Copying (excluding normal
\nuse), renting, leasing, subleasing, lending, merging or
\nmodifying the application, even partially, is also
\nprohibited. Modifying or modifying the application
\n(including its components) is prohibited, and adding a
\nnew program or feature to the application or web
\npage is also prohibited. You further agree that the laws and regulations regarding the technology and export of the device you are using must be observed when using the

\nservices. We do not control them, we have no
\nresponsibility for them and we do not verify them,
\ntheir content, instructions for use or privacy policies.
\nYou are responsible for your use of our service
\n(including if you purchase products or services from
\nthird parties).<\/p>\n
SOMETIMES ERRORS MAY OCCUR
\nDue to the nature of technology, and internet
\ntechnology in particular, we cannot promise that our
\napplication will work uninterruptedly, flawlessly or
\nmeet all your expectations. We are not obligated to
\nremedy the situation and do not compensate for any
\nloss, damage or injury you may suffer if our service is
\nunavailable.<\/p>\n
HOW WE CAN STOP OR SUSPEND YOUR USE OF THE
\nAPPLICATION
\nWe may suspend your use of the application if you
\nuse the application in a way for which it was not
\ndesigned, you do not download the latest update, you
\nuse it in a way that violates these terms, or in a way
\nthat violates laws or regulations.
\nRemember that if you upload content (such as images
\nor videos) through the application, you agree that the
\nmaterial you upload will not be derogatory, obscene,
\ninaccurate, misleading, offensive, defamatory,
\nharassing, harmful, threatening, inciting, or harassing,
\nharassing, humiliate, intimidate or irritate anyone or
\npromote discrimination, reveal anyone’s personal
\ninformation, infringe on anyone’s intellectual property
\nrights, violate anyone’s legal or contractual rights,

\nyour user account. All data and data that you have
\ncollected for the application will be deleted. We will
\nnot reimburse you for any losses or unused purchases
\nif we prohibit you from using our application. The
\nabove also applies if you decide to stop using our
\napplication. If you wish to stop using the application,
\nyou must comply with these Terms of Use.<\/p>\n
DO NOT FORGET THE TERMS OF YOUR APPLICATION
\nSTORE
\nThe app store from which you downloaded our
\napplication may have its own terms. We do not
\ncontrol them. As they may affect the use of this
\napplication (for example, in-app purchases), please
\nread them carefully.<\/p>\n
INFORMATION REQUIRED FOR LOGIN
\nBy accepting this agreement, you agree that by
\nlogging in to the service with your credentials, we can
\nassume that you are using our application.
\nYou should follow our instructions on how to protect
\nand encrypt your account from unauthorized access
\nand login (such as not choosing a password that is too
\neasy to guess). Once you have set up an account in
\nour application, you should not write your registration
\ninformation anywhere so that it is identifiable or allow
\nanyone else to use it.
\nYou must tell us if you notice any errors in your
\naccount or suspect that your credentials have been
\nlost, stolen or damaged (or suspect someone has
\ninvented the information and may misuse your login
\ninformation).<\/p>\n
OUR RESPONSIBILITY TO YOU
\nTreatment of medical problems is the responsibility of
\na properly trained professional. You should follow the
\nexercise program done by this professional for you to
\navoid excessive cognitive strain caused by any
\nsymptoms. You cannot rely on our application as the
\nonly way to rehabilitate, and you cannot make your
\nown diagnoses with our application, extend the
\ntraining prescribed for you, or offer help to other
\npeople. If you have any doubts about the legality of the exercises shown in your account, suffer from any
\npersistent and increasing pain or discomfort, or
\notherwise have additional questions about your
\ncondition or the exercises prescribed to you, you
\nshould discuss this with your healthcare professional
\nor other medical professional.
\nBy accepting these Terms of Use, you agree that we
\nwill not be liable for any loss, damage or liability you
\nmay have incurred:
\nDue to events beyond our control (such as problems
\nor interruptions in your mobile carrier\u2019s network,
\nInaccurate location or location information that may
\nbe provided by someone as part of or in our
\napplication
\nIf you are unable to follow medical or rehabilitation
\ninstructions or advice, or for any reason are unable to
\nfollow the documentation available for the
\napplication.
\nOur application is available \u201cas is\u201d and we are not
\nresponsible for any damage, error or omission in the
\ninstructions, knowledge or code used by our
\napplication. We are also not responsible for the
\ninternet or mobile connection you use. We are also
\nnot responsible for any failures, losses or damages
\nresulting from the use of our application, unless
\notherwise stated in these Terms of Use.
\nYou agree to comply with all local, regional, and
\nnational laws, regulations, ordinances, and regulations
\ngoverning the use of the Application. All promises,
\nrepresentations, circumstances and other terms
\nimplied in law are outside our agreement. Nothing in
\nthe Terms of Use shall exclude our liability in
\nsituations of death or injury resulting from our gross
\nnegligence, fraud or other reasons where our liability
\ncannot be limited or excluded by contract under
\nFinnish law.
\nExcept for the above paragraph, we (or our
\nemployees, agents or subcontractors) will never be
\nliable for any costs, damages, claims, direct or indirect
\nlosses or losses incurred by you as a result of your use
\nof our application. This includes (but is not limited to)
\nany loss of lost profits, potential loss of lost data or
\ndata, savings, business opportunities or potential
\nreputational damage, or any other financial loss.
\nOur maximum liability in connection with this
\nAgreement, any damages in connection therewith or
\notherwise (including any liability in connection with
\nany damages or negligence or omissions) is limited to
\nEUR 100 in these Terms of Use.<\/p>\n
AMENDING THE TERMS OF USE
\nWe may change the Application Terms of Use from
\ntime to time. Therefore, we hope that you will read
\nthe Terms of Use, and in particular its legal sections,
\nregularly in the latest version. We will try to inform
\nyou in advance if we are making significant changes. If
\nthe changes are large enough, we may want you to re-
\naccept the Terms of Service.
\nIf you log in to the service manually (that is, if you do
\nnot turn on the function for other logins), you must
\naccept the Terms of Use each time you log in.<\/p>\n

LAW TO BE COMPLIED WITH
\nWith this service, we comply with Finnish law. Any
\ndisputes arising from the terms of use and the use of
\nthe application will be resolved through negotiations
\nbetween the parties. If the parties cannot reach an
\nagreement, the dispute will be resolved in the Helsinki
\nDistrict Court.<\/p>\n
